HHS Issues Proposed Rule to Align Grants Regulation with New Legislation and Supreme Court Decisions

Today, the Department of Health and Human Services (HHS) issued a Notice of Nonenforcement to inform the public that certain regulatory provisions in The Uniform Administrative Requirements, Cost Principles, and Audit Requirements for HHS Awards ("HHS grants regulation") will not be enforced because of serious concerns regarding the prior administration's implementation of the Regulatory Flexibility Act, which governs the issuance of certain regulations. HHS is also taking immediate steps to address the issue by publishing a notice of proposed rulemaking to reissue the HHS grants regulation with revisions.

In summary, the proposed rule would:

- Require grantees to comply with applicable nondiscrimination provisions passed by Congress and signed into law.

- Provide that HHS complies with applicable Supreme Court decisions in administering its grant programs.

- Not re-impose the exclusion from allowable costs in grants of penalties due for failing to comply with Individual Mandate of the Affordable Care Act (ACA). The Trump Administration has already eliminated the penalty associated for failing to comply with the ACA's individual mandate.

- Reissue the other provisions of the 2016 regulation.

In the proposed rule, HHS would repromulgate most of the provisions of the 2016 rulemaking verbatim. HHS would revise two provisions of the 2016 rulemaking to require grantees to comply with applicable nondiscrimination provisions passed by Congress and signed into law, including legislation ensuring the protection of religious liberty, and to provide that HHS complies with all applicable Supreme Court decisions in administering its grant programs.
The proposed rule represents the Trump Administration's strong commitment to the rule of law―the Constitution, federal statutes, and Supreme Court decisions. These require that the federal government not infringe on religious freedom in its operation of HHS grant programs and address the impact of regulatory actions on small entities.
HHS is committed to fully enforcing the civil rights laws passed by Congress. The proposed rule would better align its grants regulations with federal statutes, eliminating regulatory burden, including burden on the free exercise of religion. HHS is affirming that it will comply with all applicable Supreme Court decisions in administering its grants programs. (Source: The White House)

Update on "Impeachment"

House approves impeachment inquiry rules after fiery floor debate


A sharply divided House voted Thursday to approve a resolution setting "ground rules" for the impeachment inquiry into President Trump, putting lawmakers on record over the contentious process while setting the stage for proceedings to move into the public eye after weeks of closed-door depositions.

The measure passed largely along party lines, 232-196. Two Democrats defected on the vote.

The first formal floor vote in relation to the impeachment probe announced a month ago by Speaker Nancy Pelosi followed a fierce debate in the chamber, where Republicans accused Democrats of launching a de facto "coup" against the president in a "pre-ordained" bid to overturn the results of the 2016 election.

"A yes vote on this resolution today gives a stamp of approval to a process that has been damaged beyond all repair and a blatant and obvious coup to unseat a sitting president of the United States," Rep. Ross Spano, R-Fla., said. (Fox News) Read more.

After the Vote: Time to Move!

The NRCC (Republicans) sent 'moving boxes' to Democrats and told them to 'Get packing.' It prompted a police investigation!


The National Republican Congressional Committee sent packing boxes to several House Democrats who represent battleground states to signify they'll need them as "moving boxes" next November, prompting Capitol Hill police to investigate them as suspicious packages.

The boxes were delivered outside the offices of Reps. Abigail Spanberger, D-Va., Jennifer Wexton, D-Va., Conor Lamb, D-Pa., and others to indicate they will not be in office much longer because of their participation into the impeachment investigation of President Donald Trump.

The sealed boxes were adorned with bows and a message that read "Get packing!"

Most of the Democrats who received packages flipped GOP districts in 2018 and will face competitive races next year to keep them. (USA Today) Read more.

The impeachment railroad


Democrat lawmakers are railroading impeachment rules into place that give a tremendous advantage to the party as it steams toward impeaching President Donald Trump. Under the guise and media narrative of having open votes to make sure things are fair, the Democrats are voting on rules that allow House Intelligence Committee Chairman Adam Schiff (D-CA) wide latitude in determining the secrecy of the hearings, unelected staff members to question witnesses, block witnesses that the Republicans would like to hear testify, and to release only transcripts that Schiff deems appropriate. All the while, Schiff and the Democrats are saying these rules bring "fairness and due process" to the impeachment inquiry.

Breitbart reports: "Again and again, Republicans offered amendments to restore the rules used in previous impeachment inquiries. For example, Rep. Michael Burgess (R-TX) offered an amendment to allow the president's counsel to be represented in all of the committees investigating impeachment, not just in the House Judiciary Committee." When Congressman Rob Wooddall (R-GA) objected that the new rules continue to allow secret hearings, and to bar the president's counsel from most of the investigative process, Congressman Jamie Raskin (D-MD) responded that the House's power over impeachment was unlimited, saying, "[W]e have the power to get the information that we want in the manner in which we want to get it."

In the past, impeachments have been investigated by only the House Judiciary Committee and witnesses could be questioned by the president's counsel. Now Democrats controlling the process will allow investigations conducted by several committees, led by the House Intelligence Committee, with no guarantees that witnesses will be questioned by the president's counsel, or that witnesses could be called by the president's counsel. Democrats said that the president's rights to due process do not apply to impeachment because it is similar to a grand jury. In this case, however, unlike a grand jury, the Democrats are leaking to the news media only excerpts of damaging testimonies to sway public opinion.

The Democrats have the votes and the power to set their own rules because they are the majority. They could impeach the president today if they wanted to, but they are stacking the process against the president and are railroading public opinion on impeachment. Republicans are unable to level the playing field. Impeachment is based on public opinion. If the public rises up against it, there will be severe consequences to the Party of impeachment. This is why the Democrats are leaking the bad information and setting the rules so that only those against the president can testify or question witnesses. Isaiah 58:1 says, "Cry aloud, spare not, lift up your voice like a trumpet, and show my people their transgression, and the house of Jacob their sins." We need to lift our voices and show Americans this travesty, and House Democrats their wrongdoing.
